Prior Notice Instructions for Deringer Clients

To complete your Prior Notice requirements clients should follow the process below so Deringer can transmit your information. If you are using other means to satisfy the requirement (such as EDI or the FDA's web page) this procedure does not apply.

• Step 1. Complete your normal shipping documents.
• Step 2. Complete the attached Prior Notice Transmission form. We will assume that any information left blank on the form is an indication that it is repetitive information found on the Commercial or Proforma invoice for this shipment.
• Step 3. Fax all documents to us at the appropriate office as soon as possible (a list of Deringer fax numbers is provided below). Documents must be received no later than FIVE (5) hours prior to a border crossing or twenty-four (24) hours before the anticipated arrival of an air or ocean vessel.
• Step 4. Deringer will send you the Prior Notice confirmation number(s) after we receive it from CBP. We will also inform you of the earliest time the shipment can arrive at the border. Shippers should not authorize the departure of their shipment until they receive this information, unless they have other safe guards in place to prevent premature arrival.

  Additional important information:

  (a) The Prior Notice confirmation notice is separate and distinct from the “May Proceed” notice currently issued by the FDA. You still need to receive a “May Proceed” from the FDA after the shipment has been released by US Customs Therefore, as is currently the case, your shipments should still be held intact until you receive a “May Proceed” from the FDA. We suggest you follow the same procedures you do today to verify your “May Proceed” notice, and recommend using the tracking tool on our website (www.anderinger.com) to facilitate this process.

  (b) CBP has indicated that they will not hold shipments for failure to follow this process during their initial phase of the requirement, unless they have determined it poses a threat identified by both CBP and FDA together. Regardless of this, Deringer strongly recommends that you make your best attempt to comply with the regulations and adjust to the new process for every shipment.
